GnozAstro Terms of Use & End User License Agreement

Welcome to GnozAstro ("the App"), developed by Laurent Bottigliengo ("Developer", "Licensor", "we", "us", or "our").
IMPORTANT: By downloading, accessing, or using the App, you agree to be bound by this single, unified agreement. This document constitutes both the Terms of Service for the astrological content and the End User License Agreement (EULA) for the software itself, as required by the Apple App Store. If you do not agree, you must not use the App.
1. License Grant and Scope
Apps made available through the App Store are licensed, not sold, to you.
Licensor grants you a nontransferable license
to use GnozAstro on any Apple-branded products that you own or control,
as permitted by the Usage Rules. This license governs any content,
materials, or services accessible from within the App, as well as
upgrades that replace or supplement the original App.
You may not:
Distribute or make the App available over a network where it could be used by multiple devices simultaneously.
Transfer, redistribute, or sublicense the App (you must remove the App from your device before selling it).
Copy, reverse-engineer, disassemble, attempt to derive the source code, modify, or create derivative works of the App, except where expressly permitted by applicable law or the licensing terms of any included open-source components.
2. Description and Intended Purpose
GnozAstro provides astrological chart calculations, AI-powered interpretations, educational content, and optional premium features.
The App is strictly for informational, educational, self-reflection, and entertainment purposes.
Content generated by the App, including AI interpretations, does not
constitute medical, psychological, legal, financial, or professional
counseling advice. Users remain solely responsible for any decisions
they make.
3. AI-Generated Content
Some interpretations are generated using third-party artificial intelligence (OpenAI and Anthropic). While we strive for quality, AI responses may contain inaccuracies, be incomplete, or reflect unexpected interpretations. You acknowledge that AI responses should never be relied upon as factual or professional advice.
4. User Information and Data Consent
a) Personal Data (Service Related):
To generate charts, you may provide your name/nickname, date of birth,
time of birth, place of birth, and questions submitted to the AI. This
data is processed according to our Privacy Policy.
b) Technical Data (EULA Related):
You agree that Licensor may collect technical data about your device,
system software, and peripherals. This data is gathered to facilitate
software updates, product support, and service improvements, and is used
in a form that does not personally identify you.
5. Subscriptions and Purchases
Certain premium features require an auto-renewable subscription or a one-time in-app purchase. Payments are processed exclusively by Apple through the App Store. Subscription management, renewals, cancellations, and refunds are strictly governed by Apple’s policies.
6. Intellectual Property & Acceptable Use
All
software, designs, graphics, text, databases, and algorithms in
GnozAstro are owned by Laurent Bottigliengo or used under license.
You agree not
to: misuse the App, attempt unauthorized access, interfere with its
operation, submit unlawful/harmful content, or use automated systems to
abuse the service.
We reserve the right to suspend or restrict your access immediately if we suspect a violation of these terms.
7. Third-Party and External Services
The App integrates with third-party services including: Apple App Store / iCloud, RevenueCat, OpenAI, and Anthropic.
Additionally,
the App may link to external websites or services. These services are
governed by their own terms and privacy policies. Licensor is not
responsible for the availability, accuracy, or operation of any
third-party External Services. You agree to use External Services at
your sole risk and must not use them to harass, stalk, or defame anyone.
8. Availability and Changes to the Service
We strive to keep the App available but do not guarantee uninterrupted operation. We reserve the right to modify, suspend, or discontinue any feature (including paid features) at any time without prior notice. We may update these Terms periodically; continued use after changes constitutes acceptance.
9. Termination
This Agreement is effective until terminated. Your rights under the EULA will terminate automatically if you fail to comply with any term. We also reserve the right to suspend your access to the service pending investigation of any suspected abuse.
10. NO WARRANTY (Disclaimer)
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE,"
WITH ALL FAULTS. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED,
OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. NO ORAL OR
WRITTEN INFORMATION SHALL CREATE A WARRANTY. SHOULD THE APP PROVE
DEFECTIVE, YOU ASSUME THE ENTIRE COST OF NECESSARY SERVICING.
11. Limitation of Liability
TO
THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE
FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR
CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION) ARISING FROM YOUR USE OR INABILITY TO USE THE APP, HOWEVER CAUSED.
THIS INCLUDES ANY DECISIONS MADE BASED ON ASTROLOGICAL CALCULATIONS OR AI-GENERATED OUTPUT.
IN NO EVENT SHALL LICENSOR’S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT OF FIFTY DOLLARS ($50.00). Some jurisdictions do not allow these limitations, so they may not apply to you.
12. Export Control
You may not use or export the App except as authorized by United States law and the laws of your jurisdiction. The App may not be exported into any U.S.-embargoed countries or to anyone on the U.S. Treasury's Specially Designated Nationals List. By using the App, you warrant you are not located in such a country.
13. U.S. Government End Users
The App and documentation are "Commercial Items" as defined in 48 C.F.R. §2.101. U.S. Government end users receive only the rights granted to all other end users per the terms herein, as per 48 C.F.R. §12.212.
14. Governing Law and Dispute Resolution
For the Service Terms (AI, astrology, subscriptions): This agreement shall be governed by the laws applicable in the Developer's country of residence [Please insert Developer's country, e.g., France].
For the Software License (the EULA):
If
you are located in the European Union, Switzerland, Norway, or Iceland,
the governing law shall be the laws of your habitual residence.
For
all other users, the license is governed by the laws of the State of
California, USA, excluding its conflict of laws provisions.
The United Nations Convention on the International Sale of Goods is expressly excluded.
